Make a Claim for Negligence

To make a compensation claim for clinical/medical negligence it must be demonstrated that:

  • 1) a duty of care owed
  • 2) a breach of that duty, which we will call negligence
  • 3) a causal link between the breach of duty and injury sustained
  • 4) a loss or injury

If all of these requirements are made then it would be fair to assume a successful compensation claim may be possible. This is a rather simplistic way of looking at the process of claiming compensation for clinical negligence.

When making a legal claim it should not be underestimated how having an experienced lawyer at their side will not only improve chances of a positive outcome, manage the process and take the mental fatigue and strain from the claimant.
